Canon Pulls Products off Amazon in Australia USA and UK

Canon Inc. continues its strategy of monitoring online sales of cartridges and has again filed infringement reports with e-commerce giant Amazon seeking the removal of listings for certain toner cartridges that allegedly infringe its patents. This time, it filed four removal requests to Amazon all on the same day in Australia, the USA and the UK.

A Report Infringement Form was filed with Amazon.com.au

based on the alleged infringement of claim 28 of Canon’s Australian Patent Number AU2007205464 regarding the cartridge model CB540A, CB541A, CB542A, CB543A, CE320A, CE321A, CE322A, CE323A, CF210A, CF210X, CF211A, CF212A and CF213A offered by Northern Supplierr under ASINs (Amazon Standard Identification Numbers) B00LVQLLDM, B00LVQM532, B00LVQM3IE, B07GJ2T9SV, B00LVQMDAW and B00LVQMBWC. After receipt of the Report Infringement Form, Amazon took down the respective products. These products are compatible with the OEM HP cartridge models and provide a non-OEM housing and a non-OEM force receiving device according to claim 28 of AU2007205464.

An infringement report was filed with Amazon.com

seeking the removal of Amazon.com listings for certain toner cartridges sold by Qwen for use in HP laser beam printers. Canon’s infringement report alleged that certain model HP 126A and 130A toner cartridges sold by Qwen via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove Qwen’s listings for those products, namely, Qwen’s listings with Amazon Standard Identification Numbers (“ASINs”) B07VHKQYNP, B07W1K2LM7, B07W54S1L1, B07W7HW7G2, B07VFMSPCQ, B07Z3BDFTY, B07VWPDM1Q, B07W2WGXYY, B07VWP5LKD, B07VXNMJCP, B07YFFNBCC, B07YFLL1TC, B07YFLRW8Q, B07YFLCMZK and B07YFMC23J. At the time of this announcement, the above-identified Qwen listings were no longer available on Amazon.com.

A second infringement report with Amazon.com

Canon’s infringement report alleged that certain model HP 126A and 130A toner cartridges sold by LEDES via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove LEDES’ listing for those products, namely, LEDES’ listings with Amazon Standard Identification Numbers (“ASINs”) B079JR1182 and B07JBC7JFJ. At the time of this announcement, the above-identified LEDES listings were no longer available on Amazon.com.

An Infringement Form was also lodged with Amazon UK

based on the alleged use of claims 1 and 2 of the UK portion of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding the cartridge models CF210A, CF211A, CF212A, CF213A, CB540A, CB541A, CB542A and CB543A offered by YulinShiHengShanQuXingPingRiYongBaiHuoDian under the ASINs (Amazon Standard Identification Numbers) B08135RZD1, B081RGNP2R, B07Z7JZVRS, B081RGHLP1, B07Z7FM83R, B081RFG1X5, B07Z7D35G5, B07Z754DSC, B081RGSC8W, B07Z76633D, B07Z76SFWW, B081RGQDKB, B07Z7CG7B6 and B07Z78ZPGB. Afterwards, Amazon took down the respective products. These products are compatible with the above OEM HP cartridge models CF210A, CF211A, CF212A, CF213A, CB540A, CB541A, CB542A and CB543A and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.
